Conditions of guarantee

The guarantee period for the Products offered by the Guarantor is calculated from the date of sale and is as follows:

  • 12 mths: GLASS™, OfficeGLASS™, TabGLASS™, PetGLASS™, ShoesGLASS™,  StripeGLASS™, CarGLASS™, SandGLASS™, WallGLASS™, WALL™Pro, WALLex™
  • 24 mths: WallGLASS™ Plus (+), CornerGLASS™ Plus (+), Corner ALU™50, CornerINOX™, WallC™, WallG™, WallWOOD™, Wall ART™, CarWALL™, CornerALU™, Wall LE™

The Guarantor provides the customer with a guarantee based on a VAT invoice or receipt confirming the sale of the Product.

The Guarantor guarantees to the Purchaser all the Products it sells and ensures the smooth operation of the Products offered, provided that they are used in accordance with their intended use and the operating conditions specified in the documentation.

During the guarantee period, the Guarantor shall repair the defective Products free of charge. If the Guarantor finds that repair of the Product is not possible or the cost of repair of the Product is disproportionately high compared to the price of a new Product, the Guarantor is obliged to replace the Product with a defect-free one.

Neither the Purchaser nor any third party shall be entitled to claim compensation from the Guarantor under the guarantee for any damage caused by the failure of the Product. The Guarantor’s sole obligation under this guarantee is to supply replacement parts or to repair or replace the Product with a defect-free Product in accordance with the terms of this guarantee.

The Guarantor shall only be liable to the Purchaser for physical defects caused by reasons inherent in the Product sold. The guarantee does not cover defects arising from other causes, in particular:

  • external factors: mechanical damage, thermal damage, chemical damage, inundation, excessive soiling, etc., or wear and tear of the Item
  • assemble and use the Product contrary to its intended use as specified in the description
  • design and purpose errors – incorrect selection of the Product
  • use of the Product under conditions which do not correspond to those stated in the description (e.g. max./min. operating temperature, pollution, harmful conditions or chemicals)
  • use of the Product contrary to its intended use and/or the art of engineering
  • incorrect assembly, maintenance, storage and transport of the Product
  • damage to the Product caused by the use of non-original accessories and materials, e.g. mounting materials, which are not in accordance with the manufacturer’s instructions
  • damage resulting from force majeure events (fire, flood, lightning, etc.).

The warranty does not cover parts subject to normal wear and tear in accordance with their intended use, e.g. abrasion of the outer layers in the event of extremely intensive use.

All items are industrial items and are manufactured with the utmost care and attention; however, the manufacturer allows a dimensional tolerance of +/-2%.

Complaint

Complaints shall not be made about customary commercial or slight deviations in colour and design of the delivered goods from their catalogue patterns.

Any physical defects in the goods delivered must be reported in writing only and, in the case of hidden defects, within 8 (in words: eight) weeks of the date on which the defect became apparent. After the expiry of the aforementioned deadlines, the Purchaser’s claims for physical defects in the delivered goods shall lapse.

In the event of a valid complaint, the Guarantor, at its discretion, may:

  • remedy the defects;
  • replace the goods with defect-free goods;
  • reduce the price of the goods and return the overpayment to the Purchaser;
  • collect the defective goods and refund the Purchaser the price paid.

Depending on the method selected by the Guarantor for settling the complaint, which the Guarantor is obliged to inform the Purchaser about in writing, the parties shall jointly determine the date by which the Guarantor is obliged to fulfil its obligation. However, in the case of stock goods, this period may not be less than 14 (in words: fourteen) days, and in the case of non-stock goods, less than 1 (in words: one) month.

If the complaint proves to be unfounded, all costs incurred by the Guarantor in connection with the complaint by the Purchaser shall be borne by the Purchaser.

Any further claims by the Purchaser shall be excluded. In particular, the Guarantor shall not be liable for any damage suffered by the Purchaser (lost profits and property loss).

Return of goods

The Purchaser shall be liable for any diminution in the value of the goods resulting from behaviour which goes beyond what is necessary to get to know the thing. The Consumer should handle and inspect the goods with due care.

If the returned goods are damaged or there are signs of use beyond the scope of a normal inspection of the goods (e.g. a soiled or partially detached bumper, a bent, detached overlay or mat, damaged tape, a liner with glue due to being rolled up or rolled on too small a diameter than those used in the production and packaging process, etc.), then the producer is entitled to compensation.

If the contract is cancelled within 14 days and the goods are returned – the Consumer shall pay the return postage to the seller. The seller shall refund the first-way postage cost equal to the cheapest postage on offer.
In the event of non-collection of a postage-paid consignment, the cost of return shall be borne by the purchaser in accordance with the applicable carrier’s price list.

In the event of non-collection of the cash on delivery, the cost of the two-way shipment shall be borne by the purchaser in accordance with the applicable carrier’s price list.

In the event of non-collection of the cash on delivery, preceded by cancellation of the contract, the purchaser shall bear the cost of the return shipment in accordance with the applicable carrier’s price list.

The right of withdrawal (return of goods) shall not apply in the case of contracts where the object of the order is a non-prefabricated item, produced to the consumer’s specifications or intended to meet the consumer’s personalised needs.
